Default cool loop hole to scam out of fines

Mario Hili reported car stolen 21 times in 13 years to avoid traffic fines

21 times at an average of $200 a pop equals $ 4200 plus interest - fine was $2500 so a saving of 1700 bucks - and no demerit points - love how they reward stupid but will charge the poor honest bloke for doing 4km's over the limit

Magistrate Stephen Myall said Hili had taken advantage of a technique which enabled him to avoid his obligations.
Mr Myall said Hili had not only escaped paying the fines but also avoided losing any demerit points as a result of his prolonged and planned offending.
He took into account Hili's age, lack of priors and plea of guilty, before convicting and fining him $2500.
No order was made in regard to Hili's licence.

Oh come on...surely after the third or forth time the authorities would start to suspect he was doing something dodgy and say "You're crying wolf...pay the damn fine"?

A similar thing happened to me a few years ago. My car was stolen and the police found it, the person who "bought" my car from someone else then said it was stolen from him when the police went to pick it up. It then happened a few months later again but the police admitted to me there was a loop hole that meant they can't do a thing till it turns up again. Biggest crock of **** I've ever heard

he should have lost the appropriate demerits ( ands corresponding loss of licence) and been given a prison term for his fraud.

It wouldn't have been picked up, because the fines department and general crime department don't exactly look for links like this.

Poor penalty handed down my the magistrate. Should have been given a hell of a lot more in the way of a monetary fine, purely for wasting Police resources as well as the fine evasion. A lengthy licence suspension that reflected the demerits he accumulated would have been good too.

Why do you people go so bezerk over these things.

He has be caught.
He has been stopped.
I suspect the loophole hase been closed.

In order for him to face all the previous penalties each one would have to be reinstated and then prossecuted at a cost of probably hundreds of thousads of dollars as they will have to prove that in each case, one at a time, the car was not stolen.

Is it really worth hundreds of thousands of dollars just so you feel better about yourself and are now not so terribly upset that someone found a loophole?

We constantly complain that government waste huge amounts of money on stupid ideas that are driven by agenda, dogma and emotion. This is no different.......

the loophole has not been closed you still have a legal defence of your car was stolen but they may be more aware of scams if it happens multiple times. by going easy on this guy they send the message out that you can commit multiple frauds avoid the initial penalty and get a slap on the wrist. this was a calculated fraud over an extended period not just a one off. he needs to be made an example of.

He was. From the story, he was charged with 'seven counts of obtaining financial advantage by deception and three counts of making a false document'. Just under a different offence, but, technically same thing.

Sure the false document wasn't the stat dec for the fines? Not the false police reports?

To get the fines waved he would have had to have filled in a stat dec.

Deception in South Australia is telling a lie to dishonestly benefit yourself or a third person, this offence covers the lie told about his car being stolen. Might be different in other states, but, I'm fairly sure it's the same. False document was likely stat decs, or other related paperwork.

All these stupid loop holes. There was one a few years ago in Victoria. You load your car up x amount of people as long as all seat belts were in use.

He probally never reported it to the insurance company.

Not hard to call the police and say, I found my car. Everything is ok.

Has anybody here ever actually been pulled over for 2km/h over the limit?

Also easier to report the number plates stolen instead of the whole car, unless he went through a toll road or the car is distinctive.
