Swanny just spoke to a lawyer friend and this is the basics of what she said:

Get the police report..thats to counter the engineer.

Her lawyer is trying to bluff you.

Engage a law firm once her side gets law firm letterheads,they will know you can't be stood over.

She pleaded guilty was convicted she is at fault and responsible for your damages.

Well guys, it looks like I'm off to a local magistrates court for a Claim form. Then I'll have to get affidavits from valuers and repairers (all witnessed by JP's). A fee of $77.00 to lodge the claim and then off to court.

Barnacus - I've spent the last 15 yrs playing 'CSI' at work, so I've rarely had to deal with solicitors. Mostly the questions I've had to answer were techniques or procedures that the lawyers/barristers had no idea about.

I've got the Union lawyers doing the injury claim, but they will charge about $200 an hour to chase the property damage up. They did go over my first response when it all started to go bad, and told me it was fine.

I think my optimism is recovering from when I got the last letter, and I'm ready to go fight it out ing_sm
