Seriously not everyone who drives a buzz box or a old V8 banger is a hoon.... I dont know what you drive but no doubt you have broken the law in it atleast once in your life. Most people break the law in their cars daily, whether they are speeding (1 km over is classed as speeding), plugging their telephone in to the power charger, or not using their indicator everytime they turn at an intersection. Doesn't matter what laws your implement or enforce the world will still be the same. People will still die on the roads regardless. I just sold my V8 partly because of this stupid law, not because I drive like a moron but simply because if a copper doesnt like the way you look at them they can pretty much throw the book at you.

Hoon laws imo are (or should be) also about anti-social behaviour. I really don't want to be woken up at 2am every morning because some dip**** wants to do donuts on the corner of my street (sorry, "our" street). I get that kids want to impress themselves and their mates with their skill and derring-do but my street or your street (or our street) ain't the place for it. Perhaps those who feel really strongly that the laws go too far could start lobbying appropriate authorities to set aside more areas for kids to "express themselves".

No they wont because they will just go and buy another one.
Its like the kids who do burnouts and wear out tyres... They dont care, they wear them out then go down to bob jane and get another set on interest free.... Then when that set wear out they go and get another set in the girlfriends name. You wont stop these sorts. All this stuff is doing is going to make life harder for enthusiasts who love their cars. It wont stop the real criminals.

I bet everyone of those that had their cars confiscated last year were innocent right? Prisons are full of innocent people too, right? King, Mandela and Ghandi never had to deal with hoons. |

Whats worse in your opinion? Speeding in a 40 zone or breaking traction at 20 kms an hour?

I see thousands of bad driver and bad driver decisions to every hoon I might see , seriously every real hoon can be done by laws that have been around forever..and put simply if they wanna hoon they will just get another cheep poobox and destroy it , they are draconian laws at best .and my opinion on hoons would be a person with a higher than your grandmas driving ability skillset .
Dangerous driving / undue noise...will get anyone stupid enough , and once their license is gone then many more laws kick in .. they can't enforce the ones they already have .

What my major issue is with all the new legislation being put forward is that police need no PROOF that you were "hooning" to confiscate/impound/fine you or your car. What is the variance between what is a legitimate hooning offense and what is simply leaving the lights quicker than the car next to you.. what are the factors that come into play, I guarantee they are not purely based on speed and noise. Factors like age of driver, type of car, the look of the car wheels etc. are all going to come into play when in reality, the only factors the should be looked at are the speed and noise. These laws are proposing to give the powers of judge and jury to the police.

I'm just saying that if it's the law, don't break it. You have been warned about the consequences. How many times do people whinge about getting a speeding fine and saying "Yeah, but I was only only doing 65 in a 60 zone" as a justification? You broke the law, pay the consequences. |

That's being remedied here in Qld. The police cars are being fitted with video and as I said before. People, just send in videos of these idiots as you will part of the solution.

it's far from the end of the world as some seem to claim new laws and road rules come in from time to time, people making exagerated claims by providing 'what if' scenarios are being unrealistic impounding of vehicles has occured for some years now, I'm yet to hear of a car being impounded for a truly accidental and brief loss of traction reality check time people |

If you can walk anywhere at 0.5 BAC that'd be amazing. Most people would be passed out. Edit: or dead.

I never said I have never broken the law. But when I have broken them, I pay the consequences. Read all my posts if you are going to make ignorant comments out of context. It must be empowering to be a car enthusiast then. Gives a right to break the law then? |

Unfortunately the laws are being created without the provision of adjudicating as to whether a event falls into your or my descriptions. I know of several examples where there has been a police chase for many kilometres where the target was totally unaware they were being chased due to other traffic and environment. If a law has no provision for flexibility then it can often invoke injustice. e.g. BAC 0.049 totally ok, 0.050 illegal, whereas the impairment of the BAC is completely different for every person and even different for the same person depending on a squillion other parametres. If someone kills another in a crash but their BAC is only 0.049 even though they were quite impared is that just "tough"? With law making it seems the focus is always "how can I look good in the public eye dealing with this problem" rather than "how can this go wrong and who will be affected when it does". |

I don't see how people aren't furious about this. Even people who don't consider themself a hoon or participate in hoon activities should be fuming about this. This gives the police power that they should not have. Confiscation and crushing/selling someones car should be up to the courts, not a cop on a bad day or a power trip.

I was referring to NSW where we've had hoon laws for some time, other states too I believe People are willing to go to prison rather than stop for police: doesn't that say something about the type of person and their absurd mindset? Why are we so worried about a car being confiscated or being crushed when prison is a far worse option and here already And yes I know of several well deserving cases of imprisonment resulting from drink driving and/or hoon type behaviour Post again twelve months after the legislation becomes law and tell me how many 'wrong' cases of impoundment/crushing you know of. My guess is none, the fear was and is unfounded |

Any resident who puts in a complaint about noise in their street will have their house confiscated after the second complaint. Will you quietly agree to this new law, or jump on and like Harold Scruby's post on "Australian Walking to the Shop" forums?

And let's be clear about this, under the traffic act, you are guilty on the word of an officer until you prove your innocence.
When you widen the scope and definition of laws, you open up interpretations of more situations to police who will invariably charge if not sure and let the courts decide your innocence or otherwise. The nett effect is more people being branded hoons under this legislative change instead of targeting those drivers who are guilty of anti-social behavior. |
