Smile Florida Class Action over Flashing Lights to Warn of Speed Traps..

Florida is facing a class-action lawsuit from drivers who have been ticketed for attempting to warn other motorists of hidden speed traps. According to WTSP 10 News, Eric Campbell was recently cited for just that, despite the fact that there is no law against using one's headlights to communicate with other drivers. The officer who ticketed Campbell used Florida State Statute 316.2397, even though the courts ruled that the police were wrongfully applying the law to crack down on vehicle-to-vehicle communication in 2005. Now Campbell wants his $100 ticket refunded and $15,000 in damages.

Since 2005, over 10,429 drivers have been cited for flashing their high beams, and if Campbell wins his case, Florida could be facing over $1 million in ticket refunds. But that's nothing compared to the $156.4 million the state could have to pay out if each driver is awarded $15,000 each

I still think the most effective way to slow drivers down (if the Government is REALLY serious) would be to pay people to drive around randomly flashing their headlights.........

No revenue in that though.

Not as many people flash here in Vic anymore, so many people think its fair enough if someone is fined doing 5 over on a safe country road now sadly. I still flash a bit (for speed cameras), but am a bit wary of who may see.

Also, I flash A LOT if there is a real cop hiding in the bushes.

My indicator and wipers are on the wrong side. So I may accidentally flash my lights while trying to wash my windows. Whoops.

i got pulled over for doing it a month or so ago. didnt get a ticket, i claimed i was flashing a guy who his headlights on full beam.
turns out thats illegal too lol, but the cop gave me a warning.
wont stop me. some things are worth a ticket.

You can get a ticket for using high beam in a built up area....

But I just accidently turn on my headlights now and then and have to turn them off quickly ;)

Meh.. 'real cop'? A Real Cop is not one that hides in the bush and patrols speed. A Real Cop rushes to emergencies and fights real crime, things that actually take guts to do.

The only thing they can ping you for if you do flash is for failing to dip your high beams within 200m of oncoming traffic.

got done flashing lights $30 ticket laughed at him when he asked why i was flashing lights and told him i had no credit to ring radio station to warn more people, still do it tho unless its school zone
